On Tuesday 22nd & Wedneday 23rd July 2014 the Planning inspectorate held a meeting at the Holiday inn , with regard to the the diversion of footpath 36 , The airport brought along no less that two barrisers (Mr Charles Banner & Ms Heather Sargent both from land mark chambers fleet street Lomdon) to present their case to the inspector, 4 SAEN footpath and water courses working party members, two representatives from the ramblers association, and 4 independent residents stood against the barristers in opposition to the diversion proposal, who with out doubt had the barrister flumuxed on many occasion.
A very important factor in this footpath diversion is Aviation way, as it is illegal to divert a footpath on to a high way. The barrister argued that this is and has always been a private road. records show that this road has been in use for 52 years at least. which is hugely important as if Avation Way has been used for 20 years or more without interuption then it is deemed a public highway, and the footpath cannot be diverted on to it,
This will cause the airport huge problems as they will not be able to further develop on that side of the airport until the footpath is diverted, (for point of reference the majority of footpath 36 will be extingquished except for a few meter and how it can be deemed a diverstion and not a stopping up). It is believed that the CAA are looking into the security of the airport (LSA) The airport are desarate to use the 1980 highways act to divert this footpath and avoid the 1982 aviation act, as this will look into all aspects of the airport not just the footpath, which from the airports point of view is to be avoided ay all cost.

If we fail to retain footpath 36 in its present location it is looking very likly that aviation way will become airside.
