  • Definitions
    In this contract, the terms have the meanings set against them:
    i. “the bird” means the parrot safehoused to the person herein named.
    ii. “the property” means the items which have been included in the safehouse programme that belong to the bird.
    iii. “the permitted Use” means the use described in item 5 of the particulars.
    iv. “the owner” means the Scottish SPCA, who is ‘safehousing’ the bird through Parrot Trust Scotland.
    v. “the safehouser” means the person that shall be contracted to care for this bird.

    Interpretation
    The owner is entitled to make amendments to this contract by way of 14 days written notice to Parrot Trust Scotland and the safehouser.

    1. I understand that the bird is the property of the owner, and that if, for any reason, I am ever unable to keep the bird, I will immediately notify Parrot Trust Scotland who will notify the owner and arrange to return the bird. I agree to not pass this bird to anyone else without the prior written approval of the owner and Parrot Trust Scotland.
    2. It is the responsibility of the safehouser to purchase and keep the dietary requirements of the bird as laid out by Parrot Trust Scotland. These costs will be reimbursed by the owner but receipts must be produced.
    3. I will provide the bird with fresh water, food, toys, any required supplements and a clean, well-ventilated living space.
    4. I will provide an approved pet carrier for the bird/s.
    5. I will immediately take the bird to a recommended qualified avian veterinarian for a complete examination upon any sign of emergency illness, and notify Parrot Trust Scotland who will notify the owner within 24 hours of any such instances.
    6. If any birds are already in the household prior to this agreement, all must be disease tested with documented proof before another bird joins the household. This is for the safety of all birds involved, and the associated vet costs of non-charity birds will need to be covered by the keeper prior to any arrangement taking place. Untested birds must not be mixed.
    7. In the event of the death of the bird, it is a requirement of this agreement that the correct procedures are followed in order to preserve the body so that an autopsy may be conducted to determine cause of death if required by the owner. Additionally, it is recommended that until autopsy results are obtained, that quarantine procedures are followed. The cost of any autopsy will be the responsibility of the owner.
    8. I will notify Parrot Trust Scotland who will notify the owner if I intend to move house/accommodation or change my telephone number or email address. I understand that continuation of the safehousing agreement may be dependent on inspection of the new property by Parrot Trust Scotland or the owner and where applicable consent from a landlord.

  • 9. I understand that parrots are very long-lived and have made, or will make, the appropriate arrangements for the bird to be returned to the owner in the event of my death.
    10. I understand that parrots are highly intelligent and need regular interaction, constant care and patience; I agree to give the bird all the attention, affection, interaction and mental stimulation he/she will need and treat him/her like a member of my family.
    11. I understand that a parrot may need time to adjust to his/her new environment and agree to work with him/her to safely assist in this adjustment.
    12. I understand that questions or concerns will arise as to the proper care and behaviour of the bird, and I agree to contact Parrot Trust Scotland with these questions/concerns. I agree that it is in the best interest of the bird to ask rather than to guess.
    13. I will keep the bird in a parrot-safe environment, free from smoke and substances toxic to parrots. A smoke and carbon monoxide detector must be in place in the safehouse and in working order.
    14. I understand that fur and feathers do not mix. Due to the potential for injury/death, I will ensure that multi-pet households activities are segregated to ensure each creature's safety. This is particularly true of scales and feathers - specifically snakes. Snakes are natural predators of parrots and can cause severe anxiety if kept within eyesight of one another. These species must be kept segregated at all times.
    15. I permit Parrot Trust Scotland and the owner or his agents in the interest of the bird to inspect the bird and his/her health on giving as much notice as possible and presenting a written authority from Parrot Trust Scotland or the owner, or agent representing the owner. This will be determined by the respective charities.
    16. I understand that the bird and the property supplied (if supplied) belong to either Parrot Trust Scotland or the owner.
    17. If at any time, it becomes the opinion of Parrot Trust Scotland or the owners that if the conditions of the safehouse are not being met, I understand that Parrot Trust Scotland or the owner or his representative may reclaim this bird irrespective of any donation or other expenditures that I have incurred or made.
    18. I understand that this is a legal and binding contract, and that Parrot Trust Scotland or the owner may terminate my right to keep and adopt the bird(s) in my possession and that, by virtue of the adoption relationship, I do not and cannot obtain any right, title, or interest in the bird(s) or the property.
    a. I understand that failure to comply with any of the terms and conditions of this agreement may constitute grounds for demanding the return of the bird and the property.
    b. I understand that reasons for demanding return are not restricted to any such breach of terms and conditions; that being within the discretion of Parrot Trust Scotland or the owner or his agents.
    c. I will return the bird and the property within twenty-four hours (or agreed timescale) upon oral or written demand by Parrot Trust Scotland or the owner.
    d. I understand that, upon oral or written demand, should I fail to return the bird and the property, my actions constitute a theft and will result in criminal and/or civil action being taken against me.
    e. I will be responsible for any and all expenses associated with the result of my failure to return the bird or the property, notwithstanding legal fees associated with obtaining the return of the bird or the property.
    f. I understand that in the event of my failure to comply with any part of this agreement, Parrot Trust Scotland or the owner may be concerned over the safety and welfare of the bird and may request that an inspector or a police constable effect entry (by force if necessary) into premises to seize the bird in accordance with the Animal Health and Welfare (Scotland) Act 2006.
    19. Except as set forth above, Parrot Trust Scotland or the owner makes no representations, warranties or guarantees, and assumes no liability for health, age, temperament (including the capacity to bite), behaviour, talking ability or condition of any birds available for placement. I, the safehouser, agree that all information that is available for the bird has been given to myself and that by signing this agreement, I am happy to continue all treatment deemed necessary by both a qualified avian vet and the owner or his agents. Parrot Trust Scotland or the owner shall not be responsible to the safehouser for any injury suffered or damage to or loss of any chattel sustained by the bird.

  • 20. I agree that I will not change the bird's name. I understand that this is important for the bird's own identification as well as for the owner's record keeping purposes. Parrot Trust Scotland will only ever change a bird's name if required for legal protection or in the case of socially inappropriate/offensive naming.
    21. Quiet enjoyment – That so long as the safehouser is not in breach of any of his obligations hereunder he shall be entitled to peaceably and quietly enjoy the bird without any lawful interruption by Parrot Trust Scotland or the owner or any person claiming under or in trust for the owner.
    22. Parrot Trust Scotland and the owner do not sell any birds, advertise any bird for sale or allow the breeding of any birds. Any breach of these terms and conditions will result in an immediate notice to surrender any safehoused parrot back to Parrot Trust Scotland or the owner for rehoming.
    23. It is my responsibility as the safehouser to ensure a clear line of communication with Parrot Trust Scotland can be upheld, managed and maintained throughout the natural life of the bird/s. It is the right of Parrot Trust Scotland and the owner to receive updates on the welfare and care of the bird/s. This communication may be oral/written/images/via Facebook messages. In the event this communication fails with no amicable solution, Parrot Trust Scotland and the owner or his representative have grounds to demand the bird/s return with immediate effect.
    24. As the safehouser, if I am no longer able to keep the bird I will immediately notify Parrot Trust Scotland who will notify the owner and arrange to return the bird at my own expense.
    25. I agree that any questions/concerns/grievances relating to the agreed safehousing conditions, the owner and/or his representative must address these via direct written communication and/or using the complaints procedure form located on the Parrot Trust Scotland website. I understand that statements which may have potential to cause defamation to Parrot Trust Scotland, the owner and/or his representatives, by means of, but not limited to libel, slander, harassment, malicious falsehood and negligence will result in point 17 of this agreement being utilised with immediate effect.
    26. As the safehouser, I will maintain confidentiality as to the owner of the bird(s) and will not use any social media (e.g. [but not limited to] Facebook, Twitter, Instagram, press) to post pictures or information about the birds.
    27. In the event of any adverse incident (e.g. harm, loss, theft) then I will notify Parrot Trust Scotland immediately who in turn will notify the owner.
    28. This contract and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter or formation shall be governed by and construed in accordance with the law of Scotland; and the parties agree that the Scottish courts shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with this agreement.
