Delivery of Unedited Proofs and Final Image Retouching
Unedited proofs from your photography session, typically comprising approximately 20-50 pictures, will be made available for your viewing within 10-14 business days through an online gallery. Please note that unedited proofs are not included in your selected photography package.
Selection of Final Images:
You will have the opportunity to select your favorite photos from the unedited proofs for final retouching, based on the number of images included in your chosen package. Please refer to your selected package for specific details regarding the number of images that will be retouched.
Online Gallery Contents:
The online gallery will contain low-quality, unedited proof images along with some edited examples to provide you with a preview of how your finished images will appear.
Copyright Protection:
The images in the online gallery must not be copied, screenshotted, downloaded, printed, edited, or altered in any way, under any circumstances. Any such actions would constitute a violation of copyright law.
Final Image Delivery:
Your finished images will typically be ready for delivery within 7-10 business days from the date of your order. Please note that this timeframe is a guideline and not a guarantee.
Watermarks:
All watermarks will be removed from the images you choose to purchase.
Sharing with Friends and Family:
You are welcome to share your proof gallery link with friends and family at your own discretion.
Image Retention:
Little Feet Photography by Edyta Gradzka is unable to store unwanted images indefinitely. Images not purchased within a period of 3 months following the photoshoot will be considered unwanted and will be deleted from our systems without further notice.
Client Responsibility:
Once the images have been purchased, it is the client's responsibility to back up the digital files. Little Feet Photography by Edyta Gradzka is no longer responsible for the digital files once they are taken by the client.
PAYMENT
A non-refundable booking fee paid by bank transfer along with a completed contract will confirm your booking. Payment for the photographic package is payable on the day of the contracted date by cash or bank transfer or within 3 days from the session day by bank transfer. All additional goods are payable on ordering.
Title to all goods remains the property of the Photographer until paid for in full by The Client(s).
Payment by the Client will be expected for the commissioned work within 14 days of the issue of the invoice by the Photographer. If the invoice is not paid, in full, within 14 days:
The Photographer reserves the right to charge interest at the rate prescribed by the Late Payment of Commercial Debt (Interest) Act 1998 (currently Bank of England base rate plus 8%) from the date payment was due until the date payment is made, plus any debt recovery costs.
Where extra expenses or professional time are incurred by the Photographer as a result of alterations to the original order/booking by the Client, or otherwise at their request, the Client will be liable to pay such extra expenses or fees at the Photographer's normal rate to the Photographer in addition to the expenses previously agreed or estimated.
Liability for Injury and Studio Session Conduct
Child Behavior in Studio Sessions:
Parents, please be aware that it is your responsibility to ensure that your children are under control during the session. We understand that children may feel out of their element in a new environment, and their behavior may differ from what you are accustomed to. However, if a child consistently misbehaves, damages studio equipment, or acts disrespectfully, we may need to stop the session. In such cases, no refunds will be available.
Photographer's Liability:
The photographer shall not be liable for the death, personal injury, or other losses sustained by the client, their guests, invitees, or other individuals involved in the event/booking, except where such liability is mandated by applicable law.
Safety in the Studio Environment:
While all reasonable and proportionate efforts are made to maintain a safe studio environment, clients acknowledge that certain elements in a studio setting can pose risks. For instance, effect lights can be hot, heavy, and sharp, and photographic equipment can create tripping hazards. Therefore, clients accept that some inherent risk may exist within the studio environment, and the photographer disclaims any liability for such risks.
Equipment Failure and Negligence:
The photographer is not legally responsible for accidental equipment failures or injuries to clients, their invitees, or others involved in the event, except when such injury is primarily and directly caused by the photographer's negligence.
Responsibility for Children:
Regarding events involving infants and children, the clients, parents, and guardians of children attending the event bear full and exclusive responsibility for the care and conduct of the children. The photographer shall not be liable for any injuries or losses sustained by children attending the events, unless mandated by applicable law.
Out of Studio Events:
For events held outside the studio, the photographer shall not be liable for the environmental and physical characteristics of the venue or any hazards and risks willingly assumed by the client. The photographer will not knowingly or recklessly expose the client to any hazards not typically associated with the venue or hazards and risks willingly assumed by the client.
