Annie Allen Photography - Terms & Conditions
By signing this contract you are agreeing to the following terms and conditions:
1. Payments. No booking is valid until the booking fee is received. Any remaining balance will be due 2 weeks prior to the session date. Failure to pay the remaining amount within this time will result in your booking being cancelled. All booking fees are non-refundable. Payments to be made via bank transfer only.
2. Cancellation. All booking fees are non-refundable after 14 days from when the payment is received, however there may be a small admin fee to process your refund within this time period. (If your session is within this 14 day period then this 14 day refund does not apply.) Booking fees are needed to confirm the booking slot and failure to attend the session results in the Photographer’s loss. If the client shall cancel due to sickness then the deposit may be carried over to another session date at the discretion of the Photographer, if the session is rescheduled within 14 days of the original session date. Failure to reschedule in time or to attend the rescheduled session will result in the client’s booking fee being lost. Sessions may only be rescheduled once. Session times can not run over. If Clients are more than 30 minutes late this will result in the session being cancelled and the session fee will be lost.
3. Failure to Perform. If the Photographer cannot perform this agreement due to an event that is out of the photographer’s hands, the Photographer’s illness, in the event that photographic materials are damaged, lost through camera or computer malfunction the Photographer shall return the amount paid to the Client but shall have no further liability with respect to the Agreement. In the event the Photographer fails to perform for any other reason, the Photographer shall not be liable for any amount in excess of the retail value of the Client’s order.
4. Liability. The photographer is not responsible for any injuries inflicted upon any participating parties. The client will be responsible for their children and for themselves and release the photographer from any claims against their person or their business. The Clients will waive, disclaim and release Annie Allen photography from any and all actions, claims or demands that they may have now or in the future, including those related to injury, damage, loss or destruction of property.
5. Model release. The images remain the property of Annie Allen Photography. The photographer may use some images for their portfolio, website, advertising, & promotions.
6. Reshoot policy. A reshoot will be offered in the unfortunate event of the photographers equipment malfunctioning. A reshoot will not be offered due to an uncooperative subject or in any situation that is out of the photographer’s control. If the client is unhappy with the images then a reshoot may be offered at a discounted price if the reshoot is booked within 14 days. Any reshoot sessions are determined at the discretion of the photographer.
7. Copyright. Any images or copies of are protected by the Copyright and Design Act 1988. All original files and copyrights shall remain the property of the Photographer. Any portion of the work delivered to the client is for the client’s personal use only and the client may not sell or authorise the sale of any portion of the work without the Photographer’s written consent. Images can not be altered, cropped, converted or have filters added.
8. Prices. The charges in this Agreement are based on the current session fee for a 1-2 hour shoot or until the Photographer feels that they have a good range of images. Prices and packages may be adjusted periodically and future sessions shall be charged at the prices in effect at the time when the session is booked. The number of people present for a session will also be at the photographers discretion and the Photographer may not perform the session if extra people turn up without notice.
9. Viewing Appointments. If you have purchased package 1 then a 30 minute viewing appointment will be scheduled for 2-3 weeks after your session for you to choose your images. All selections are to be made at the time of viewing and so only one appointment will be given. Payment for any additional images are to be made at the viewing appointment via bank transfer, cash or PayPal. The Photographer can not store customer files for a long period of time and so any images that are not purchased will be removed after this time. It is the responsibility of the Client to download and save their images after receipt. The Photographer will not be held responsible for any damaged or misplaced images after this time.
10. Consent. If a minor child is present for the photo shoot I certify that I am legally able to give consent for them to be photographed.
