I am fully aware of the inherent risks and hazards associated with active travel and specifically the activities organized by Garda Moments. This may include, but not be limited to bicycling, bicycle selection and maintenance, walking or hiking, transportation failures, accidents or illness in remote places without access to medical facilities, transportation or means of rapid evacuation and assistance, physical exertion for which I am not prepared, negligent or reckless cycling by me or others, weather conditions, consumption of alcoholic beverages, breakdown or failure of bicycles or other equipment. I am aware that such activities may include inconvenience, illness, injury, emotional trauma or even death. I am electing to voluntarily participate in these activities, knowing that my participation may be hazardous to me and/or my property. I voluntarily assume full responsibility for any risks of loss, property damage or personal injury, including death that I may sustain, whether caused by the negligence of the Releasees, listed below, or otherwise.
I hereby Release, Waive, Discharge, And Covenant Not to Sue Garda Moments, its officers, agents, partners, employees, tour guides and other staff and suppliers (Releasees) from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to my property, while participating in activities organized by the Releasees.
I further Agree to Indemnify and Hold Harmless the Releasees from any loss, liability, damage or costs, including court costs and attorney’s fees that Releasees may incur due to my participation in these activities.
I agree that this Limitation of Liability, Release and Indemnity will apply to my tour with Garda Moments, or any transfer of reservation to another tour, including any pre-trip or post-trip extensions. This Limitation of Liability, Release and Indemnity is binding upon me, as well as all members of my family, my dependents, estate, heirs, successors and legal personal representatives.
I understand that payment of the reservation deposit constitutes acceptance of the Terms and Conditions as described above. I understand that I must sign a Release of Liability prior to the start of my trip with Garda Moments or will be required to do so upon arrival. I also understand that I must have personal health insurance to participate in the activities of Garda Moments.
