  • Notice To Quit

  • Important Notes 

    1.       Subject to the terms of the tenancy, in serving this notice the tenant will end the tenancy at the Property.

    2.       Once served, this notice cannot be withdrawn.

    3.       If as a former tenant you remain in occupation of the Property after the last day of the notice period, you will be treated as a trespasser.

    4.       If as a former tenant you remain in occupation of the Property after the last day of the notice period, the Landlord will claim mesne profits for the continued use of the Property.

    5.       Mesne profits are damages for the Landlord being deprived of the use of the Property by a trespasser and do not count as 'rent' and as such the Landlord is not creating a new tenancy by accepting such payments from you as a former tenant.

    6.       The amount of mesne profits claimed is equivalent to double the rent that you as a former tenant were paying immediately before the last day of the notice period [Section 18 of Distress for Rent Act 1737]. 

    7.       The mesne profits will be claimed for the entire period you as a former tenant remain in occupation of the Property.

    8.       A joint tenant can unilaterally end the joint tenancy by serving a valid notice to quit.

    9.       Where a former joint tenant remains in occupation of the Property after the last day of the notice period, the Landlord will claim mesne profits for the continued use of the Property as defined above.

    10.     If the landlord gives you consent to remain in possession of the Property after the last day of the notice period, it does not imply the grant of a new tenancy and would be without prejudice to any right the landlord has for possession. If such consent were given, your status as an occupier would be as a 'tolerated trespasser' (not a 'tenant') and you would be liable for payment of 'mesne profits' (not 'rent'). The terms for mesne profits are the same as those for rent applicable on the last day of the tenancy.

    11.     You remain liable for the whole of the rent that was due on the last day of the notice period even if you vacate the Property before the last day of the notice period.

    12.     You remain liable for the cost of utilities or water charges or environmental services or other similar services or Council Tax incurred at the Property until the last day of the tenancy even if you vacate the Property before the last day of the notice period.

Also check if there is any contractual obligation in the tenancy agreement that requires a longer notice period]

  • Hint: The expiry date above should be the last day of the period of the tenancy in which you wish to terminate the tenancy OR the first day of the new period of the tenancy after which you wish to terminate the tenancy. In either case, the notice period must be the minimum required by your tenancy agreement - commonly at least one calendar month. 

  • Savings Clause

    If the above expiry date is not on the first or last day of a period of the tenancy, this notice will expire on the next, last day of a period of the tenancy which falls after one month has passed from the service of this Notice unless there is a contractual obligation in the tenancy agreement that requires a longer notice period.
