1. General
A signed "Course Booking Detail" is required to confirm the services of the provider. It is agreed that the terms set out in this booking form is the total agreement made between the parties and that no variation or modification of this contract shall be effective unless agreed by both parties in writing.
2. Payment
The provider will make no other reservations for this date and time once the signed "Course Booking Detail" has been received. Payment will be strictly on 30-day terms. If payments fall after this time, future bookings may be subject to a non-refundable deposit.
3. Cancellation
After a period of 14 days from the date of signing the contract, as compensation for loss of income for the provider, the following charges apply as a percentage of the total fee due:
Less than 6 months’ notice – 100% of fee
More than 6 months’ notice – 75% of fee
Cancellations must be received and acknowledged in writing. All costs incurred by Provider will also be due.
4. Event Arrangement
The details of the arrangements are to be agreed beforehand using this form. Any changes to this form, which are not agreed prior to the event may result in cancellation. The Provider cannot be held liable for delays or disruption in their delivery of the service if any changes are not received and acknowledged in writing
5. Copyright
The 1988 Copyright Design & Patents Act – Section 77 & 80 issues copyright of all notes and materials to the provider. It is against the act to copy or allow copying of these unless given permission by the provider in writing.
6. Royalty Free License
It is prohibited to allow suppliers and third parties to use the materials, notes and content without the expressed written consent of the provider and a payment of the appropriate fee as determined by the provider. Clients who permit their attendees to use the provider’s content without proper authority will be issued with a breach of copyright notice and required to pay compensation. The supplier will also be issued with a breach of copyright notice and required to pay compensation.
7. The Provider & Limitation of Liability
In the unlikely event of severe medical, natural or other emergencies on behalf of the Provider, every effort will be made to secure a replacement speaker able and/or willing to provide a similar package as chosen in this agreement at a similar tariff. If such a situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event package. The provider has full professional indemnity insurance.
8. Force Majeure or Act of God
The performance of this contract shall be contingent upon Acts of God, flood, fire, warfare, Government laws or regulations, electrical failure, strikes by suppliers and/or conditions beyond its control.
9. Travel and Accommodation
Travel and accommodation charges are agreed with the client at the time of booking and must be agreed in writing.
