Re: Race for Future Contributor Release Form
Thank you for agreeing to participate in the Race for Future project (the “Production”). We write to you to ask you to sign, date and return this letter to us to confirm the basis on which we can use and refer to your contribution to the Production (and, in the future, our other products and/or services) including all audio and/or visual content identifying you (“your Content”) and all use of your name, any fame and image including, where applicable, your
nickname, initials, signature, endorsement, reputation, computer generated or animated portrayal, photographs, biographical information and personal data relating to you (“your Image Rights”).
In consideration of this written agreement, it is agreed as follows:
1. Your Age : You promise Wild Tiger Films Ltd. that you are over 18 years old and, if requested, will present proof of your age to us by way of supporting documentation (including an original birth certificate and/or valid passport).
2. Nature of the Production : You acknowledge and agree that Wild Tiger Films Ltd. has fully explained your contribution to the production, and you acknowledge and understand that the production is a documentary-style project about the global climate crisis.
3. Licence : You hereby grant Wild Tigers Films Ltd. an irrevocable, worldwide, perpetual, freely assignable and sub-licensable, exclusive and royalty-free licence and permission to use and exploit your Content and your Image Rights (and all rights that subsist therein (including all copyright (including all copyright in literary, dramatic and musical works), moral rights and related rights, trademark rights and all other intellectual property rights and all other similar or equivalent rights subsisting now or in the future in any part of the world, in each case whether registered or unregistered and including
all applications for, and renewals or extensions of such rights for their full term)) both in relation to the Production (including its publication and in its marketing and promotion) and any other product and/or service that Wild Tiger Films Ltd. may bring to market throughout the world and on any platform and in any media (now known or hereinafter invented)(the “Licence”).
4. Moral Rights : You hereby irrevocably and unconditionally waive what are known as your “moral rights” (including any rights you may have under sections 77 and 80 of the UK Copyright, Designs and Patents Act 1988 (and any equivalent or similar laws of any other jurisdiction)) in both your Content and your Image Rights.
5. Data Protection/GDPR : You hereby provide Wild Tiger Films Ltd. with all necessary permissions and consent to enable Wild Tiger Films Ltd. to use your Content and/or your Image Rights pursuant to the Licence under the Data Protection Act 2018 and the General Data Protection Regulation ((EU) 2016/679). You acknowledge that Wild Tiger Films Ltd. is the controller and responsible for the personal data comprising your Content and your Image Rights, together with any other contact details (and any related personal data) that you provide to Wild Tiger Films Ltd. under this letter (for the purposes of this clause your Content, Image Rights and any other contact details and personal data being the “Data”). You agree that Wild Tiger Films Ltd. may use the Data, including storing copies for as long as is necessary to fulfil the purposes of the Licence, storing the Data on its database in case it needs to contact you. You release Wild Tiger Films Ltd. from any claims and any losses or damages which you may suffer arising out
of Wild Tiger Films’ use of the Data in line with the foregoing, including any claims relating to defamation or privacy.
6. Wild Tiger Films’ Liability : Wild Tiger Films Ltd. will not be liable to you for any loss or damage or injury to you or your personal property caused or suffered during or in connection with your participation in the Production unless directly caused by Wild Tiger Films’ negligence and recoverable on that ground.
7. Confidentiality : You agree not to disclose to any third party your involvement in the Production or anything you learn about Wild Tiger Films Ltd., its business or the Production (or any of its other products/services) without Wild Tiger Films prior written consent.
8. Governing Law/Jurisdiction : This letter agreement shall be interpreted and construed in accordance with English law and shall be subject to the exclusive jurisdiction of the English courts.
