    Please find enclosed the membership pack for joining the Scottish Knight League. Please complete all forms and return them to your local club (team) treasurer along with the current fee of £30. The membership fee is payable by anyone who handles any of the equipment or armour at anytime. This is due to current UK laws regarding Public Liability Insurance.
    Those who are resident outside of Scotland please complete the Memorandum of Understanding. The SKL will contact the Captains of the respective National Teams to get them countersigned. Without this document you will not be eligible to represent Scotlandon the international stage.

    BACKGROUND:                                                           

    A. This memorandum is between the Scottish Knight League (SKL) and fighters who's primary residence is outwith the country of The United Kingdom and it's environs.
    This Document will establish the basic terms to be used in a future agreement between the Parties.The terms contained in this Document are not comprehensive and it is expected that additional terms may be added, and existing terms maybe changed or deleted. The basic terms are as follows:


    Non-Binding:                                                                

    1. This Document does not create a binding agreement between the Party and will not be enforceable. Only the future agreement, duly executed by the Party, will be enforceable. The terms and conditions of anyfuture agreement will supersede any terms and conditions contained in this Document. The Party are not prevented from entering into negotiations with other third parties with regard to the subject matter of this Document.


    Transaction Description:                                                 

    2. The subject of this transaction is described as follows:
    - The fighter whilst a member of the Scottish Knight League and residency outwith The United Kingdom, shall, only be entitled to tryout and represent Scotland at IMCF World Championships or at HMBIA (Battle
    of the Nations) Championships. No other National team may be approached in regards for selection to that said team.

    Closing Date:

    3. The transaction will be completed on or about the 31st day of December, 2019 (the "ClosingDate"). All obligations as indicated in any future agreement will be completed and met by the Closing Date.


    Representations:

    4. The merging Party represents and warrants that their respective assets, real property or personal property, which constitutes any or all of this proposed transaction, are free and clear of any liens, charges, encumbrances or rights of others. If the representations of one or more of the Parties are untrue upon the Closing Date, then any remaining Parties may terminate any future agreement without penalty.

    THIS ACTIVITY WAIVER  &RELEASE (this"Agreement")


    BETWEEN:

    Scottish Knight League of 2 Burraness, Mossbank, Shetland, ZE2 9TG (the"ActivityProvider")

    IN CONSIDERATION OF the covenants and agreements contained in this Agreement and other good and valuable consideration, the receipt of which is hereby acknowledged, the parties to this Agreement agree as follows:


    Consideration

    1. Being of lawful age and in consideration of being permitted to participate in the activity described below, the Participant releases and forever discharges the Activity Provider, its owners, directors, officers, employees, agents, assigns, legal representatives and successors from all manner of actions, causes of action, debts, accounts, bonds, contracts, claims and demands for or by reason of any injury to person or property, including injury resulting in the death of the Participant, which has been or may be sustained as a consequence of the Participant's participation in the activity described below, and not withstanding that such damage, loss or injury may have been caused solely or partly by the negligence of the Activity Provider.


    2. The Releasor understands that the Releasor would not be permitted to participate in the activity described below unless the Releasor signed this Agreement.

    DetailsofActivity

    3. The Participant will participate in the following activity: The sport of Medieval Armoured Combat. Also known as HMB/Bohurt. Training for this sport at various venues across The United Kingdom. Also the participation of local and National Tournaments, both in Scotland, UK and other parts of the world.

    Concurrent Release

    4. The Participant acknowledges that this Agreement is given with the express intention of effecting the extinguishment of certain obligations owed to the Participant and with the intention of binding the Participant's spouse, heirs, executors, administrators, legal representatives and assigns.


    Fitness to Participate

    5. The Participant acknowledges that the Participant does not have any physical limitations, medicalailments, physical or mental disabilities that would limit or prevent the Participant from participating in the above mentioned activity. If required, the Participant wil lobtain a medical examination and clearance.

    Full and Final Settlement

    6. The Participant here by acknowledges and agrees that the Participant has carefully read this Agreement, that the Participant fully understands the same, and that the Participant is freely and voluntarily executing the same.

    7. The Participant understands that by signing this Agreement, the Participant agrees to be forever prevented from suing or otherwise claiming against the Activity Provider for any property loss or personal injury that the Participant may sustain while participating in or preparing for the above noted activity.

    8. The Participant has been given the opportunity and has been encouraged to seek independent legal advice prior to signing this Agreement.

    9. This Agreement contains the entire agreement between the parties to this Agreement and the terms of this Agreement are contractual and not a mere recital.

    Governing Law

    10. This Agreement will be construed in accordance with and governed by the laws of the country of Scotland.

  • Any signature (including any electronic symbol or process attached to, or associated with, a contract or other record and adopted by a Person with the intent to sign, authenticate or accept such contract or record) hereto or to any other certificate, agreement or document related to this transaction, and any contract formation or record-keeping through electronic means shall have the same legal validity and enforceability as a manually executed signature or use of a paper-based recordkeeping system to the fullest extent permitted by applicable law, including the Electronic Communication Act 2000, and the parties hereby waive any objection to the contrary.
